3.6 Dismissal of HP Faculty Members - HP Faculty Handbook
If action to terminate a faculty member appointed under this system is being considered during the period of appointment, the dismissal process shall be as follows. Prior to initiating termination action, the Unit Administrators (Chairs) shall consult with the Dean/separately reporting director who shall consult with the Provost to determine if initiation of termination action is appropriate.
An HP faculty member must be notified that the University is considering dismissal, and the basis upon which dismissal is being considered. Upon notification, the HP faculty member must have the opportunity to meet with the appropriate responsible administrators to review the reasons that dismissal is being considered. The faculty member shall have an opportunity to present verbal and written evidence in support of his/her position and in response to the reasons for dismissal set forth by the responsible administrators. At this meeting the HP faculty member may be accompanied by a representative of his/her choosing including legal counsel. The responsible administrators may also be advised by legal counsel. After the above referenced meeting, if the responsible administrators believe that dismissal is warranted, termination action may be taken.
Alternative actions, such as letters of warning or reprimand, suspension with or without pay, reductions in salary, etc., are also options which may be instituted by the unit administrator, following consultation with the individuals referenced above. Any sanction more severe than a written reprimand may be imposed only by the overseeing dean/separately reporting director, and after prior approval of the Provost. The institution of any of these sanctions must be communicated in writing by the unit administrator, accompanied by the reason(s) why the particular sanction was invoked.
If termination action is taken, the administrator must provide a written termination notice to the HP faculty member including the reasons for termination and inform the HP faculty member of the right to file a grievance under the Faculty Grievance Policy. The Health Programs Faculty may file a grievance under the Faculty Grievance Policy on the basis that the personnel action was unwarranted, arbitrary or capricious. An HP faculty member will be terminated no earlier than 120 days after the date of the official termination notice. Practice privileges may be suspended by the Deans of the Medical and Nursing Colleges at any time.
