The University may provide time-and-one-half overtime pay for some nonexempt employees under the Fair Labor Standards Act (FLSA) and/or exempt employees with contractual rights. Eligible employees earn overtime at the rate of one-and-one-half hours for each hour worked over 40 hours in a week (including paid leave). See appropriate Collective Bargaining Agreement for details in determining whether to use overtime pay versus compensatory time and for additional details on overtime provisions.
Compensatory time off: To be mutually arranged between the employee(s) and the unit administrator (see Policy and Procedure for compensatory time for record keeping and requirements).
Procedure
Overtime:
Unit administrator: See appropriate Collective Bargaining Agreement for overtime eligibility and computation.
- Determine if overtime is needed and schedule employee(s) accordingly.
- Provide as much advance notice to the employee(s) as is practicable.
- Maintain accurate records of scheduled overtime hours worked.
Payment of overtime:
Unit administrator: If employee(s) is to receive pay for overtime, submit a labor payroll time report directly to Payroll Office by biweekly pay period, if practicable. AP employees level 12 and above, and Nurses level 74 and above, must submit Special Payment Authorization form for approval to MSU Human Resources Employee Records.
Payroll Office: Issues overtime check at appropriate biweekly or monthly pay period.
