09. Grievance Procedure (Staff Handbook for the Continuing Appointment System of the NSCL)

9.1    Any CA staff member may initiate a grievance alleging a violation, misinterpretation, or misapplication of existing policies or legislation, applicable in a department of the Laboratory, the Laboratory as a whole, or the University. Informal resolution of a grievance must be attempted through discussion with appropriate Laboratory administrators, prior to initiating a formal grievance.

9.2    In the event that the grievance is not satisfactorily resolved informally, the CA staff member may request administrative review by the Department Head by submitting a statement of the grievance, in writing, within 30 working days of the act or omission which provided the basis for the grievance. The grievant shall have an opportunity to meet with the Department Head and may present testimony or evidence, either oral or written, and call witnesses. The Department Head may call witnesses and may request testimony or evidence, either oral or written, from faculty and staff who may have information germane to the case. The Department Head also may arrange for the grievance to be studied by an ad hoc panel of CA staff and/or TS faculty to provide advice concerning a response to the grievance. When this process is completed, but not later than 30 working days after receipt of the written statement of the grievance, the Department Head will provide the grievant with a written response stating action which the Laboratory will take in response to the grievance.

9.3    If the response to the grievance is not satisfactory to the grievant, an appeal may be lodged with the Director of the Laboratory within 20 working days of receiving the response of the Department head, and within a further 20 working days the Director of the Laboratory will provide the grievant with a written response giving the results of her/his review and revisions, if any, in the actions of the Laboratory in response to the grievance. All Grievances may be further appealed to the Provost, who, within 20 working days of the receipt of the appeal, shall render a final and binding decision. In reviewing appeals, the Director and/or Provost shall be provided with a statement of the grievance, any testimony or evidence provided by the parties in the initial Hearing, and a copy of the Department Head's and Director's response to the grievance. As appropriate, they may receive additional testimony or evidence, either oral or written, from the parties to the grievance or from other staff and faculty who may provide information or advice relevant to the grievance
