The following policy on additional work for pay applies to staff appointed in the CA system. The Director of the Laboratory is the individual responsible for administering this policy.
Consulting and Other Outside Work by Full-Time CA staff
CA staff members on full-time appointments are compensated for full-time service to the Laboratory. Their responsibilities encompass a combination of independent research activities and contributions to the research activities and capabilities of the Laboratory as a whole or of the relevant research group in which they are appointed. The Laboratory expects that each CA staff member will carry a reasonable full-time load, assuming a proper share of the total functions and responsibilities of the Laboratory.
Through consulting relationships with government, industry, public organizations and others off-campus, CA staff can be an invaluable resource. The Laboratory encourages the lending of such assistance where it does not interfere with the employee's performance of Laboratory duties and where no conflict of interest exists.
The following guidelines are intended (1) to provide for CA staff on full- time appointments to engage in a limited amount of outside work for pay and (2) to protect the integrity of the employee-University work relationship. The Laboratory is authorized to promulgate more specific guidelines or to require additional reporting as its circumstances dictate. Individual departments, with the approval of the Laboratory Director, are authorized to establish lower maximum time limits for outside work for pay than stipulated in point j. below, and to promulgate more specific guidelines or to require additional reporting as their circumstances dictate.
a. 'Outside work for pay' is defined as work for pay for other than Michigan State University.
b. In this context, 'work' is understood to include consulting, advising, research, demonstrating, teaching, etc. Not included is appearance on the program of a scientific or scholarly meeting attended mainly by professional peers.
c. Prior written approval of the Department Head and the Laboratory Director must be obtained if the work is done during the regular employment period.
d. All full-time CA staff shall promptly report to their Department Head outside work for pay.
e. Such work must not interfere with the CA staff member's normal Laboratory duties, including research and non-research responsibilities expected of all CA staff.
f. The work must be related to the CA staff member's normal Laboratory duties.
g. 'Pay' is defined as any salary, fee, honorarium, or monetary gift or contribution beyond actual expenses.
h. The following classes of outside work for pay require advance authorization:
1. That performed during times considered to be normal working periods for the employee by the Laboratory (to be determined by the Laboratory Director).
2. That performed outside normal working periods but potentially affecting the performance of the individual's Laboratory assignment (based on the judgment of the Laboratory Director).
If, in the opinion of the Department Head or Laboratory Director, the outside consulting work interferes with a staff member's regular Laboratory duties, the appointment of a CA staff member may be changed to a part-time basis, or a CA staff member may be requested to take a leave of absence.
i. Outside work for pay shall be authorized by the Department Head with the approval of the Director of the Laboratory.
1. Such work must contribute to the effectiveness of the employee's regular assignment in the Laboratory.
2. Equipment, supplies, materials, or clerical services of the Laboratory or the University may not be used in the furtherance of outside consulting work for pay.
j. The total amount of time expended by a full-time CA staff member on outside activities for pay and overload pay time through continuing education should not exceed 32 hours in any month. Under special circumstances and with permission of the Director of the Laboratory, the monthly time limit may be exceeded, provided the aggregate of such time for the period of authorization does not exceed an average of 32 hours per month.
k. If outside work for pay is undertaken, it must be with the understanding that it is subject to termination at any time the Laboratory considers such action to be advisable.
l. A special form is available from the Laboratory Director's office for use by the employee seeking authorization to perform outside work for pay. Completed forms shall be maintained for three years in the Laboratory Director's office.
The Laboratory Director is required to maintain a record in her/his office of all outside work for pay of full-time CA staff.
This policy cannot be used as a basis for establishing and maintaining a private practice or separate business by a full-time staff member.
Consulting and Other Outside Work by Part-Time CA Staff
A CA staff member on a part-time appointment shall regularly report aggregate hours of outside work for pay to the Laboratory director. Scheduling of the part-time CA staff member's Laboratory work assignments is in all cases to be based on needs of the Laboratory as determined by the staff member's department head.
